How rent updates work in Spain

Rent on a residential lease can only be updated if the contract says so expressly, and at most once a year on each anniversary. If the contract doesn't mention updates, there is no increase.

The landlord must also notify you of the increase in writing at least thirty days in advance, stating the percentage and the resulting figure. An increase applied without that prior notice is not enforceable.

Since Law 12/2023 the update has had a legal ceiling, which has changed over time: first a transitional fixed percentage and, since 2025, the IRAV published monthly by the INE. The index agreed in the contract still applies, but never above that ceiling.

  • 2023 updates: 2% maximum.
  • 2024 updates: 3% maximum.
  • Updates from 2025: capped at the IRAV published by the INE, for contracts signed on or after 26 May 2023.

Frequently asked questions about rent increases

How much can my rent go up this year?
At most, the percentage agreed in your contract, and never above the legal ceiling in force in the month of the update. Since 2025 that ceiling is the IRAV published by the INE, which through 2026 has hovered around 2.4%.
Can my rent be raised if the contract says nothing?
No. Article 18 of the LAU requires an express agreement: if the contract has no update clause, the rent stays the same for its entire term.
What if they raise it more than the legal maximum?
The excess is not enforceable. You can send the landlord the correct calculation in writing and keep paying the updated rent within the legal limit; if you've already overpaid, you can claim those amounts back.
What exactly is the IRAV?
It's the reference index for updating residential rents, created by Law 12/2023 and published monthly by the INE. It was designed to be more stable than the CPI so rent increases don't track inflation spikes.
