Rent-stressed market areas in Spain

Under Spain's Law 12/2023 on the right to housing, a regional government can declare a municipality a stressed residential market area where rents have spiralled. That caps how much rent can rise on new contracts and strengthens tenant protections. Here are the municipalities we've verified, grouped by region.

What a rent-stressed market area is

It's a declaration, made by a regional government and approved by the Ministry of Housing, that in a municipality (or part of it) rent absorbs a disproportionate share of residents' income, or has risen well above the CPI in recent years. The declaration lasts 3 years and can be renewed.

In these areas, if the landlord is a large holder (10 or more urban properties, or 5 in some regions), the rent on a new contract cannot exceed that of the previous contract on the same property, barring narrow exceptions. For an individual landlord there's no such strict cap, though staying within the INE's reference price index is strongly advised.

Tenants in a stressed area can also request an extraordinary extension of up to 3 years when the contract ends, in certain situations of vulnerability, and the landlord can no longer pass on certain costs — such as letting agency fees — that used to fall on the tenant.

What if my municipality isn't on this list?
We can't confirm it isn't a stressed area: this list is a sample, not the full official registry. Check your region's resolution published in the BOE, or ask your local council directly.
Who declares an area as stressed?
The regional government proposes it, showing the criteria in Law 12/2023 are met (rent absorbing over 30% of average household income, or rent rising more than 3 points above the CPI over 5 years), and the Ministry of Housing approves it. The declaration is valid for 3 years and can be renewed.
Does a stressed area affect a contract I already signed?
